Terms of Service
These terms apply when you use the SoundPath website (soundpathlearning.com.au) and the SoundPath app (app.soundpathlearning.com.au), together called "SoundPath". By creating an account or using SoundPath, you agree to them. Please also read our Privacy Policy, which explains how we handle personal information.
1. Who we are
SoundPath is operated by Penny Widdowson, trading as SoundPath Learning (ABN 26 289 980 423), a sole trader based in Bendigo, Victoria, Australia. "We", "us" and "our" mean the operator. You can contact us at penny@connectmultisensory.com.au.
2. What SoundPath is, and what it isn't
SoundPath is an online structured literacy and phonics program for learners, used with the support of a parent, carer, teacher or tutor.
SoundPath is an educational tool. It is not a diagnostic, medical or therapeutic service, and it does not diagnose dyslexia, auditory processing disorder or any other learning difficulty. Its placement checks are a guide to a good starting point, not an assessment of ability. If you have concerns about a learner's reading, hearing, vision or development, please speak to a qualified professional.
3. Accounts
- Accounts are for adults: parents, carers, teachers and tutors. You must be 18 or older to create one.
- You add learners to your account and are responsible for how they use SoundPath. Learners sign in with an access code or link that you give them.
- When you add a learner, you confirm that you are their parent or carer, or that you have permission from them (for example, as their school) to use SoundPath with the learner.
- Keep your sign-in details private. You're responsible for activity on your account.
- School accounts may be covered by a separate written agreement. If it conflicts with these terms, that agreement applies.
4. Free trial, fees and payment
- New family accounts can try one unit free, with no card required.
- Prices are in Australian dollars and include GST. Payments are billed by Connect Multisensory, Penny's business, and processed by our payment provider, Stripe; charges show "SOUNDPATH" on your card statement. We don't see or store your card details.
Monthly membership
- Monthly membership is $15 a month, charged automatically each month until you cancel.
- You can cancel at any time. Cancelling stops further payments, and your access continues until the end of the month you've paid for. We don't refund part-months.
- We may change the monthly price. We'll give you at least 30 days' notice by email before a new price applies to you.
Founding lifetime membership
- Founding lifetime membership is a one-off payment of $150, open to the first 30 families only. There's nothing more to pay.
- It covers one family account, all the learners in it, and every module we add, now and in future. It can't be transferred to another family.
- Because it's a one-off lifetime purchase, we don't offer change-of-mind refunds or cancellations.
- "Lifetime" means for as long as SoundPath operates. If we ever stop running SoundPath, we'll give members at least 3 months' notice.
Nothing in these terms limits a refund you're entitled to under the Australian Consumer Law, for example if SoundPath has a major problem we can't fix.
5. Using SoundPath fairly
Please don't:
- share your account or learner access with people outside your family, class or school;
- copy, resell or republish SoundPath's lessons, audio, videos or worksheets, except printing worksheets for your own learners;
- try to access other people's accounts or data, or disrupt or overload the service;
- upload anything unlawful or harmful.
We may suspend or close an account that breaks these rules. Where it's reasonable, we'll contact you first.
6. Our content
The lessons, audio, videos, worksheets, software and SoundPath name belong to us or the people who license them to us. Your membership lets you use them with your own learners while your account is active.
7. Your information and learners' work
You keep ownership of the information you add and the work learners create, including recordings. You let us store and use it to run SoundPath for you, as described in the Privacy Policy.
8. Availability and changes
We work to keep SoundPath running and accurate, but we can't promise it will always be available or free of errors. We may improve, change or remove features over time. If we make a change that significantly reduces what you've paid for, we'll tell you and you can cancel.
9. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights.
10. Limit on our liability
To the extent the law allows:
- where our liability for failing to meet a consumer guarantee can be limited, it is limited to supplying the service again or paying the cost of having it supplied again;
- we are not liable for indirect or consequential loss; and
- our total liability to you for any claim about SoundPath is limited to the fees you paid us in the 12 months before the claim, or $150 if you are a lifetime member, whichever is more.
This doesn't limit liability that can't be limited by law, such as for personal injury caused by our negligence.
11. Ending your account
You can stop using SoundPath and ask us to close your account at any time by emailing us. When an account is closed, we delete its information as described in the Privacy Policy.
12. Changes to these terms
We may update these terms. The version and date at the top show when they last changed. For significant changes, we'll tell you by email or in the app before they take effect. If you keep using SoundPath after that, the new terms apply.
13. Law that applies
These terms are governed by the laws of Victoria, Australia.
